Your Response

Diversion programs are alternative forms of sentencing that involves offenders joining some form of rehabilitation programs to help remedy behaviors that led to the original arrest thereby avoiding conviction and a criminal record. Diversion programs can either be pre-booked or post-booked. Pre-booked diversion programs identifies people with probable cause for arrests and then redirects them to obtain quality community-based supports and treatment services instead of booking them for incarceration. An example of a diversion program is the Florida Crisis Intervention Team Policing which is a pre-booking intervention program that targets individuals with mental illness. The CIT training program entails the provision of extensive training to police officers so that they can effectively respond to mental illness crises. The officers are armed with proper skills to be able to de-escalate crises that involve individuals with mental illness (Eleventh Judicial Circuit Florida, n.d.).   

It is important to evaluate the effectiveness of diversion programs to ensure that they are fostering the required results. Significant amounts of efforts and resources are usually channeled towards such diversion programs and so it is vital to ensure that the desired results are being met. In addition to determining the effectiveness of the program, evaluations also help to identify areas of weakness so that appropriate measures can be taken to foster further improvements. Dewa, Loong, Trujillo, & Bonito (2018) evaluated the effectiveness of pre-booking police diversion programs in general to determine whether they help in reducing the number of arrests of individuals with mental illnesses. Individuals with mental disabilities are at greater risk of being arrested as compared to the general population.

The evaluation by Dewa, Loong, Trujillo, & Bonito (2018) established that the pre-booking diversion programs are effective in reducing the criminalization as well as the rates of arrests of people with mental illnesses. Watson and Fulambarker (2013) evaluated the effectiveness of the crisis intervention team (CIT) to effectively and adequately address the needs of individuals with mental illnesses. As a collaborative model meant to safely and adequately link individuals with mental illnesses to appropriate services and divert them from the criminal justice system if appropriate. The CIT model is an evidence-based intervention that has been successfully utilized as a best practice by many law enforcement agencies.

The CMHP police pre-booking program in Florida has demonstrated excellent results and can therefore be considered to be effective in reducing the number of arrests of individuals with intellectual disabilities. Approximately 1800 officers have been provided with the CIT training with more than 900 of them on active duty at the moment. As a result of the utilization of the CIT training model, there has been a considerable reduction in the number of individuals in acute psychiatric crises who have been arrested and booked into jail. Rather, the CIT training program has led to an increase in the number of mentally ill individuals receiving crisis care within the community rather than being arrested and sent to jail.

Recidivism is an important problem within the American criminal justice system as more than 68% of released prisoners are rearrested within three years of being released while more than 75% find their way back into prison within five years of release (Rossman, Willison, Lindquist, Hardison, & Lattimore, 2016).The high rate of recidivism can be attributed to the numerous challenges that released prisoners face post-release as most of them return to the community with limited education, few job skills, unstable housing, fragile support networks, and substance abuse and other issues (Rossman, Willison, Lindquist, Hardison, & Lattimore, 2016). There is therefore a need for effective reentry programs and the Second Chance Act fosters increased reentry programming for released prisoners. The Georgia prisoner reentry program is a strategic plan, based on the Second Chance Act, aimed at fostering case management, accountability planning, and evidence-based practices for returning prisoners (Georgia Department of Community Supervision, n.d.)

Determining the effectiveness of reentry programs is vital to ensure that the desired results are being met. Second chance presents the criminal justice system with the most effective solution to reduce recidivism, homelessness, and unemployment by providing an efficient platform for empowering participants to make positive and sustainable personal changes that will favorably impact the society. Initiatives that follow the second chance guidelines such as the Georgia prisoner reentry program works by providing workforce readiness training and job placement for both the adults as well as the youths. In addition to increasing the employability of returning citizens, the program also avails other support services including transitional planning, financial literacy, and behavioral health treatment so as to foster self-sufficiency and reduced criminal tendencies.

An evaluation of the effectiveness of the Second Chance reentry initiatives in the States of Georgia, Mississippi, and Alabama was conducted. The results of the study showed that three years prior to the intervention, all the three states had an increase in the number of new sentences with Mississippi leading with 246, Alabama following closely with 131, and Alabama with an increase of 131 (Amasa-Annang, & Scutelnicu, 2016). Three years after the intervention, however, the slope in new sentences reduced significantly showing a considerable reduction in recidivism in the states of Georgia and Mississippi. The state of Georgia experienced a decrease of 4145 while there was a decrease of 1798 new sentences in Mississippi (Amasa-Annang, & Scutelnicu, 2016). There was no decrease in the state of Alabama.

All in all, the evaluation showed that the Second Chance initiative has had a considerable and positive impact on the rates of recidivism within two states out of three. It resulted in a significant reduction in the number of young adult ex-offenders in Georgia but showed no significant effect in Alabama. An important point to note is that the reentry program in Georgia which received six grant awards had the highest rate of decline in recidivism rates while the other two states each had two grants (Amasa-Annang, & Scutelnicu, 2016). Therefore, this finding suggested that the adequacy and appropriateness of funding of such reentry programs is crucial to the successful implementation of the reentry programs. The results of this evaluation affirms that the availability of rehabilitative services for offenders can appropriately help in reducing the chances of reoffending among young adult male offenders.

Your Response

Probation is a critical component of the criminal justice system given increased prison overpopulation and the exploding costs of incarceration. Probation plays a key role in helping promote community safety and reducing the rates of recidivism. An example of an evidence-based probation program is the California realignment probation program. As part of recent reforms in probation in California, the probation departments were tasked by the realignment to supervise particular offenders who were previously under the responsibility of state parole agencies (Nguyen, Grattet, & Bird, 2017). Given that the California county department supervises more individuals than any other department within the state, the reforms enhanced opportunities for the probation departments by shifting some supervision responsibilities from state prisons to probation departments and county sheriffs (Nguyen, Grattet, & Bird, 2017).

The realignment probation initiative increased the seriousness that was accorded to offenders under supervision. The realignment led to the addition of two categories of offenders – those under mandatory supervision and those under post-release community supervision – who had a tendency to be convicted for more serious offenses. An evaluation of the programs under the realignment initiative revealed positive impacts. After three years of the realignment, the share of the added populations on all new probation case increased while felony and misdemeanor probation cases in general declined (Nguyen, Grattet, & Bird, 2017). However, the evaluation also proposed that additional research should be carried out to provide a comprehensive and complete picture of the real impact that the criminal justice reforms in California have had.

A separate evaluation was conducted by Bird and Grattet (2018) to evaluate the effects that the realignment practices have ha don the rates of recidivism within the state of California. The reali8gnment efforts resulted in the number of non-violent, non-sexual, and non-serious offenders who remained in the counties for incarceration and supervision rather than being transferred to state prisons. In addition, as counties continue to concentrate more resources on the more serious crimes such as drug offenses and felonies, there has been an upward trajectory in the share and number of people serving time in jail or held for drug or felony charges (Bird, & Grattet, 2018).

Concerning the issue of recidivism, the evaluation established that the number of recidivism rates declined after the realignment. Data that was collected prior to the realignment showed that there was a tendency for individuals sentenced to more than a year in custody to serve prison or jail terms. However, the realignment created split sentences that included shorter jail terms coupled with probation terms. The resultant effect was that there was a reduction in the number of recidivating individuals. The one-year reconviction rates were down by a margin of 3.8% while the two-year reconviction rates were down by 2.0% (Bird, & Grattet, 2016). These results show that the California realignment reforms targeting the probation department have been effective in helping reduce the rates of recidivism by increasing the success of released offenders effectively integrating back into the community.

Advancing treatments for family violence perpetrators is a vital component of the criminal justice system and a valuable investment that can greatly assist in reducing the rates of reoffending and protecting the victims of family violence. An example of an evidence-based domestic violence offender rehabilitation treatment program is Colorado’s differentiated DV offender treatment. This court-ordered treatment for domestic violence offenders targets the three key areas of responsivity, needs, and offender risks (Davis, & Avalon, 2015). The risk principle is focused on ensuring that the level of service has been matched to the offender’s risk of offending. The needs principle targets the assessment of criminogenic needs so as to identify risk factors of criminal behaviors and advance effective treatments that targets such needs. The last facet, responsivity, entails efforts that are aimed at maximizing the learning process of the offenders through tailored interventions and cognitive behavioral treatment.

An evaluation of this differentiated model of treatment based on the needs, risk, and responsivity principles has shown effectiveness in helping reduce the general rates of recidivism among offenders (Davis, & Avalon, 2015). A 2015 report by researchers from the University of Colorado and the University of Baltimore indicated that the treatment program is no longer a one size fits all but a comprehensive initiative that differentiates among the needs, responsivity, and risk principles (Davis, & Avalon, 2015). In addition, a survey conducted by providers showed positive results as it indicated that about 94% of providers agreed that offenders are effectively assessed before beginning treatment.

The domestic violence treatment program has managed to attain significant successes. The state has managed to incorporate victim safety into the treatment model, enhanced decision-making consensus among MTT members, and achieved a successful transition to a team-based approach for offender containment and treatment (Gover, Richards, & Tomsich, 2015). The report showed that among 3311 offenders who were ordered by the court to complete treatment, 10%, 43%, and 47% were placed in level A, B. and C treatments respectively. The offenders placed in level A and B treatments showed high levels of consistency and did not need treatment at discharge.

On the other hand, for those offenders who were placed in level C intensity treatment at intake, only 25% were reduced to the intensity levels B or A by the time of discharge. The completion rates of treatment were also favorable as a high percentage of those on intensity level A (89%) completed treatment, 68% of those in treatment level B completed treatment, while 48% of those in treatment level C managed to complete their treatment (Gover, Richards, & Tomsich, 2015). All in all, the Colorado domestic violence treatment program showed considerable effectiveness sin helping rehabilitate offenders thereby promoting public safety while at the same time reducing the rates of recidivism.
