Assume you are an official in a Department of Veterans Affairs hospital (historically known as the VA). A gravely ill man comes to you facility suffering from terminal cancer. He insists that he contracted his illness as a result of exposure to various toxic substances while serving with the U.S. Army in Desert Storm, the 1991 MiIDle East conflict. He demands that your facility provide him with medical care and that the VA and other government agencies provide financial and counseling services to his wife and children. (Endnotes omitted.)
Checking with your superiors, you find that while the VA has not taken a final position on how to deal with all aspects of what is being called Gulf War Syndrome, the Departments preliminary position is that there is no clear basis for finding that any exposure to the combat arena in the Iraq conflict resulted in a service-related disability requiring VA support.
How do you handle this case? In the interests of fairness and compassion, would you try to bend the law to help this veteran? Do you some discretion to help this man because the Agencys policy is not yet final? If you chose to help this man because you believe his cause is a just one, what are the limits on your actions? Would you admit him for testing? For treatment? Would you be able to help his family as he asks? To what extent is the issue of how to handle this case and ethical question? To what extent a legal question? (Cooper, p.5)
