Ciacchi (2016) On April 1, 2016, the state of Oregon enacted a statute requiring all individuals who own a vehicle manufactured prior to 1990 pay a “collector’s” tax, amounting to approximately $150 a year. Critics of the tax argued that it was an unreasonable “deprivation of property” (i.e. money) that violates the 14th Amendment’s due process clause. Bill Brown, who created a petition to repeal the tax, argued that “in today’s fast-paced, interconnected society, the right to drive a car is fundamental. Without a car, people often cannot find or hold work, raise their children, or live their lives in any meaningful way. Anytime the government passes a law that infringes on this right, courts have a duty to examine the law with the strictest possible scrutiny.”
