I would like help with writing an opening presentation in small claims court. I am the plaintiff suing my landlord for illegally withholding my security deposit. In June 2015 my landlord and her son came to the house in an attempt to repair a leak in the upstairs bathroom. She accused me of not letting her know right away and I told her it just happened last night and I notified her this morning. I then asked her if she had been drinking and she said yes, I had a few mimosas, is that a problem for you? I then said, no, but that explains the reason why you are speaking to me in this tone. Shortly after she left she phoned me and said that she didn’t appreciate the way I spoke to her in front of her son. I apologized, but knew that I should have probably started looking for a new place at that time. She then came over to the house to give my family watermelon. Her Son was not able to fix the leak and she requested the assistance of our neighbor who is a professional plumber. On October 24th we received a certified letter from the Bossermans asking us to vacate the premises withing 60 days. On the same day that this letter was issued we received a letter from the HOA at Parkhaven telling us that we were noisy. I then reached out to them for clarification and asked that a new letter be issued with they did. This letter proved that it was not my family who was causing disruption.
