Case 4
In the case Peterson vs Hewlett-Packard, I do think that the employer’s action is reasonable to both diversity and Peterson’s reaction. Peterson admitted that his posters were “intended to be hurtful†and since they were viewed in a hurtful manner it violated the company’s policy. Due to that violation Hewlett Packard required that Peterson remove the posters. Research shows, “supportive workplace policies can help to promote an inclusive climate for all workers which, in turn, can condition more favourable treatment of LGBT people by their heterosexual coworkers†(Ng, & Rumens, 2017). I believe the company was attempting to create an inclusive environment, however, instead of the poster saying “Gay†the title of this poster could have also been more inclusive and read “Sexual Orientationâ€. Likewise, with the poster that read “Blackâ€, more tactfully could have read “African Americanâ€. Sometimes, it’s not what you say but more of how you say it. Or in this case write it. Also, the employer allowed him time off with pay to reconsider and he came back to work and continued his same actions.
It is the courts job and position to see all sides and conclude based on evidence provided, and I believe the court balanced both sides. “Peterson offered no evidence, circumstantial or otherwise, that would support a reasonable inference that his termination was the result of disparate treatment on account of religion.†(Bennett-Alexander & Hartman, 2015. p. 532)
Being all inclusive is not a difficult task, however pleasing all employees within a work environment is an extremely difficult task. Using language that is inclusive is extremely important as seen in this case. A diversity program in a workplace needs to create an environment that is safe, encouraging, and accommodating. “Managers are vital for implementing diversity management programs, because many if these programs focus on reducing discrimination among employees related to selecting, appraising, developing, and promoting…which are decision that are mostly contingent on managers.†(Madera, 2018. p. 439). 1 Peter 3:8 (ESV) keeps it simple, “Finally, all of you, have unity of mind, sympathy, brotherly love, a tender heart, and a humble mind.â€
