Issue: Did the test violate Title VII?

Decision: Judgment for Teachers. The Court found that the Board violated Title VII by requiring Plaintiffs to pass the test as a condition to receiving teaching licenses because the test was not properly validated and thus it was not job-related.

Reasoning: Pursuant to Title VII, it is illegal for employers to discriminate on the basis of race, color, religion, sex, or national origin. Plaintiffs can prove discrimination in 2 ways: Disparate treatment and disparate impact. This case is an example of disparate impact. Although the intent was not necessarily discriminatory, sometimes even laudable, the impact of the school district’s actions here, impacted a protected group of people in a discriminatory way. Without proof that the test was job-related, there is no justification for the discrimination, making it illegal.
