CASE BRIEFS

There are a number of formats by which a case may be “briefed.” The
following structure is the one I want you to carefully follow. Note that
the entire brief is on a SINGLE page. For each brief you should write
out the words “name,” “citation,” “facts,” “holding,” “reasoning“ and
possibly “dissent.”
Case Name: example: SMITH V. UNITED STATES
example: 423 U. S. 1845 (1933)
Facts: Create three or four sentences which summarize the important
facts of the case. Do not simply copy everything in the case that sounds
like a fact. Select the actual facts that explain what happened. Examples
of important facts: “Police obtained a search warrant.” “Smith ran from
police and was observed to throw an object in the river.” “Smith was
convicted of breaking and entering, but not burglary.” Examples of
unimportant facts: “The Court of Appeals overturned the conviction.”
“The exclusionary rule states that illegally obtained evidence may not
be used in court.”
Issue: Usually there is only one issue in a case. It sets out WHY the
case is important; why did the court on appeal (usually the U.S.
Supreme Court) chose to examine this case. The issue should be
stated in the form of a question.

Example: Does the 4”‘ Amendment require that law
enforcement officers obtain a warrant before making a routine (non-
emergency) felony arrest inside a suspect’s home?C
