Was the contract a bilateral or a unilateral contract? Should Chenard win? Is it ethical for
marcel Motors to refuse to give the automobile to Chenard?
This is a unilateral contract. Just like other contests / promotions the offer is being accepted through the performance / actions of the offeree (Chenard). Through his payment of the entry fee and the witnessed hole – in – one, he accepted the contract with Marcel Motors to win the car. It was not until the hole – in – one happened that the contract was actually accepted, which therefore by definition makes this a unilateral contract. Chenard is ultimately awarded the amount that the car was stated to be worth. It is not ethical for Marcel Motors to refuse the prize. Just because you did not think that anyone would be able to win the prize you are offering, does not mean that you can renege on your contract.
