Assignment: Please answer the following in two or three paragraphs:
John Smith has been employed by ABC Company for more than 15 years as a supervisor in the customer service department. He is
very successful at his job and he supervises 10 customer service representatives. He has been diagnosed with lung cancer and
has informed his manager that he will need to take a leave of absence from work for 8 weeks in order to undergo and recover
from removal of one of his lungs. Once he has recovered from the surgery, he will be able to return to work, but will only be
allowed by his doctor to work part-time for first 6 weeks back to work. After that, he can return to work full-time, but will
need time off intermittently to undergo chemotherapy treatments. He will probably need 1 day a week off every two weeks to
have the treatments and the day following the treatment to recover from the effects of the treatment. The treatments will
continue for 6 months. John is requesting FMLA.
John?s manager, Dave Jones, has come to you, the HR manager for advice on next steps. While Dave is sympathetic about John?s
problems, Dave is wondering how he will keep the customer service department going without a supervisor for months on end.
Keeping in mind the laws regarding FMLA and ADA, what advice and direction will you give Dave Jones on how this matter will
be handled?
